These Terms of Service ("Terms") govern your use of Hollowfall (the "Game"), including the Game's website, browser application, mobile application, and optional online services such as Cloud Save.

The Game is developed and operated by Heorhii Tomiuk, based in Ukraine ("we", "us", or "our").

By accessing or using the Game, you agree to these Terms. If you do not agree with these Terms, please do not use the Game.

1. About the Game

Hollowfall is a turn-based role-playing game that can be played offline.

The Game does not require an account to play its offline functionality.

Some features, including Cloud Save, require an internet connection and authentication.

2. Eligibility

You may use the Game only if you are legally permitted to do so under the laws applicable to you.

If you are under the age required to enter into a binding agreement in your country or region, you should use the Game only with the involvement or permission of a parent or legal guardian where required by applicable law.

The Game is not intentionally designed to collect personal information from young children.

3. License to Use the Game

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Game for your personal, non-commercial entertainment purposes.

This license does not transfer ownership of the Game or any intellectual property to you.

You may not:

copy, reproduce, distribute, or publicly display the Game except where permitted by applicable law;
sell, rent, sublicense, or otherwise commercially exploit the Game;
attempt to gain unauthorized access to the Game or its servers;
interfere with the operation or security of the Game;
use automated systems, bots, scripts, or other methods to interact with online services in an abusive or unauthorized manner;
modify or tamper with the Game or its online services for unauthorized purposes; or
use the Game in a way that violates applicable law.

Nothing in these Terms is intended to restrict rights that cannot legally be restricted under applicable law.

4. Offline Gameplay and Local Saves

The Game is designed to support offline gameplay.

Game progress created during offline gameplay may be stored locally on your device or browser.

You are responsible for maintaining your own device and local storage.

Local game data may be lost if, for example, you:

clear browser storage or application data;
uninstall the Game;
reset or replace your device;
use a different browser or device; or
otherwise remove locally stored Game data.

We are not responsible for the loss of locally stored Game progress where such loss results from your device, browser, operating system, or actions taken by you.

5. Cloud Save

The Game may provide an optional Cloud Save feature.

Cloud Save allows you to associate your Game progress with an authenticated account.

To use Cloud Save, you may be required to provide an email address and authenticate using a one-time password (OTP).

Your use of Cloud Save is also subject to our Privacy Policy.

Cloud Save is intended to provide convenient storage and synchronization of Game progress. It is not a guarantee that your Game data will be permanently preserved.

We may need to temporarily suspend Cloud Save for maintenance, security, technical problems, or other operational reasons.

We may also discontinue Cloud Save in the future, subject to applicable law and any rights you may have.

You should not rely on Cloud Save as your only means of preserving important Game progress.

6. Accounts

If you use Cloud Save, an account may be created or maintained through our authentication provider.

You are responsible for maintaining access to the email address associated with your account.

You must not knowingly allow another person to use your account in a way that violates these Terms.

If you believe that someone has obtained unauthorized access to your account, please contact us at playhollowfall@gmail.com.

7. Prohibited Activities

You agree not to use the Game or its online services to:

exploit bugs or vulnerabilities in a way that interferes with the Game or other users;
attempt to gain unauthorized access to other users' accounts or Game data;
interfere with or disrupt the Game's servers, databases, or infrastructure;
introduce malware or other harmful code;
use bots or automated systems to abuse online functionality;
circumvent technical restrictions designed to protect the Game or its services;
conduct fraudulent activity; or
violate applicable laws or regulations.

We may take reasonable action to protect the Game, its users, and its infrastructure against abuse or unauthorized activity.

8. Intellectual Property

The Game and its contents, including but not limited to:

software and source code;
artwork and graphics;
characters;
names and logos;
music and sound effects;
writing and story content;
user interfaces;
animations; and
other original content

are owned by us or licensed to us and are protected by applicable intellectual-property laws.

Except for the limited license granted by these Terms or rights provided by applicable law, you receive no ownership rights in the Game or its content.

You may not use our intellectual property outside the Game without our permission, except where permitted by applicable law.

9. Updates and Changes to the Game

We may update, modify, improve, or change the Game from time to time.

Updates may add, remove, or modify features, gameplay systems, content, balancing, or technical functionality.

Some updates may be necessary for security, compatibility, or legal reasons.

We do not guarantee that every feature of the Game will remain available indefinitely, subject to any rights you may have under applicable law.

10. Availability

We aim to keep the Game available and functional, but we do not guarantee that the Game or its online features will always be available, uninterrupted, or error-free.

Offline gameplay may continue to function without an internet connection, but online features such as Cloud Save require connectivity and may be unavailable from time to time.

Online services may be affected by maintenance, technical failures, security incidents, infrastructure providers, network problems, or circumstances outside our reasonable control.

11. User Content

If the Game allows you to submit, upload, or otherwise provide content to us or to other users in the future, additional rules may apply.

Unless explicitly stated otherwise, you retain ownership of content that you own.

By submitting content to functionality that requires us to host, store, or display it, you grant us the limited rights necessary to provide that functionality.

We will not use your content for purposes unrelated to providing the relevant functionality except as described in our Privacy Policy or otherwise permitted by applicable law.

12. Suspension and Termination

We may suspend or terminate access to online features or an account where reasonably necessary to:

address abuse or security threats;
investigate fraudulent or unauthorized activity;
enforce these Terms;
comply with legal obligations; or
protect the Game, our infrastructure, or other users.

Where appropriate and reasonably possible, we may provide notice before taking such action.

Termination of an account may result in the loss of access to Cloud Save and associated Game progress.

Nothing in this section limits any rights or remedies you may have under applicable law.

13. Disclaimer

To the maximum extent permitted by applicable law, the Game is provided on an "as available" basis.

We do not guarantee that the Game will always be uninterrupted, completely error-free, or compatible with every device, browser, operating system, or hardware configuration.

Nothing in these Terms excludes or limits warranties, guarantees, rights, or remedies that cannot legally be excluded or limited under applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be responsible for indirect, incidental, special, consequential, or similar losses arising from your use of the Game.

This may include loss of data, loss of progress, or interruption of access to online features, except where such liability cannot legally be excluded or limited.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Game, our services, applicable laws, or other circumstances.

When we update these Terms, we will change the "Last updated" date at the top.

If we make material changes that require additional notice under applicable law, we will provide appropriate notice.

Your continued use of the Game after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

16. Governing Law

These Terms are governed by the laws applicable to Ukraine, except to the extent that mandatory consumer-protection or other laws applicable to you provide otherwise.

If you are a consumer, nothing in these Terms is intended to remove or restrict mandatory rights that apply to you under the laws of your country or region.
